Chairman Hendrickson called the County Board meeting to order at 9:30 am on June 12, 2020.

Pledge of Allegiance.

Roll call

taken by County Clerk Jensen.  29 Present, 0 Absent.  Chairman Hendrickson declared a quorum present.  Present were Supervisors Flink, Leichtman, Schindler, Wilcox, Amacher, Waichulis, Zank, Kodl, Lange, Luchterhand, Jalling, Petke, Bower, Krempasky, Rogers, Hendrickson, Rueth, Olson, Williams, Krause Jr., Rollins, Smagacz, Boon, Trunkel, Gerhardt, Bakker, Garbisch, Neville and Sebesta.  

Appointments:

Chairman Hendrickson reappointed Bonnie Matkovich, Roy Tyznik and Gary Leichtman to the Community Services Board.  Motion by Supervisor Kodl seconded by Supervisor Rogers to concur with the appointments of the Chair.  Voice vote, motion carried.

Chairman Hendrickson reappointed Art Petke to the Veterans Service Commission.  Motion by Supervisor Bower seconded by Supervisor Smagacz to concur with the appointment of the Chair.  Voice vote, motion carried.

Chairman Hendrickson reappointed Larry Biddle to the Planning & Zoning Committee Board of Adjustment.  Motion by Supervisor Waichulis seconded by Supervisor Wilcox to concur with the appointment of the Chair.  Voice vote, motion carried.

Reports:

Chairman Hendrickson yielded the floor to Brittany Mews to present the 2019 annual Health Department Report.  Motion by Supervisor Rogers seconded by Supervisor Bakker to receive and file the report.  Voice vote, all ayes, motion carried.

Chairman Hendrickson yielded the floor to Marcia Ziegler to present the 2019 annual Veterans Report.  Motion by Supervisor Petke seconded by Supervisor Smagacz to receive and file the report.  Voice vote, all ayes, motion carried.

Chairman Hendrickson yielded the floor to Mary Sladich to present the 2019 ADRC Report.  Motion by Supervisor Bakker seconded by Supervisor Trunkel to receive and file the report.  Voice vote, all ayes, motion carried.

Chairman Hendrickson presented Mary Sladich with a plaque for her 45 ½ years of service to the Clark County Aging & Nutrition Programs.  Mary is retiring next week.

Mary introduced Lynn McDonald the new ADRC Director.

COVID-19 UPDATE: 

The COVID-19 Crisis Team gave an update.  

Resolution 13-6-20 APPROVING EXTENSION OF COVID-19 PUBLIC HEALTH PROCLAMATION AND ADMINISTRATIVE FLEXIBILITY presented.  Motion by Supervisor Krempasky seconded by Supervisor Rogers to approve the resolution as presented.

Jake Brunette presented a PowerPoint presentation regarding the history, impact and recommendation for resolution 13-6-20.  Motion by Supervisor Rueth seconded by Supervisor Sebesta to amend the resolution by changing the date on Lines 53 and 81 from July 17, 2020 to July 6, 2020, with tier 3 being effective that date also.  Supervisor Luchterhand spoke against the amendment.  Roll call vote on the amendment, 12 yes, 17 no, amendment failed.  Voting yes were Supervisors Schindler, Wilcox, Waichulis, Kodl, Lange, Jalling, Bower, Hendrickson, Rueth, Boon, Garbisch and Sebesta.  Several constituents were yielded the floor to speak regarding the resolution.  Roll call vote on Resolution 13-6-20, 13 yes, 16 no, motion failed.  Voting yes on the resolution were Supervisors Flink, Amacher, Zank, Luchterhand, Krempasky, Rogers, Olson, Williams, Krause Jr., Smagacz, Trunkel, Gerhardt and Bakker.

Supervisor Rogers left the meeting at 12:50 pm.
Resolution 14-6-20 APPROVAL OF THE TOWN OF MENTOR CEMETERY ADDITION PLAT
presented.  

NOW, THEREFORE BE IT RESOLVED, that the Clark County Board of Supervisors approves the creation of a cemetery as platted certified on June 1, 2020, located in part of the NE ¼ of the SE ¼ of Section 19, T24N, R4W, Town of Mentor, in Clark County, Wisconsin.

BE IT FURTHER RESOLVED, that the Clark County Clerk shall record said plat and resolutions of the Town of Mentor and Clark County Boards approving such cemetery plot within 30 days as required by Wis. Stat. 157.07. 

Motion by Supervisor Waichulis seconded by Supervisor Krempasky to approve the resolution as presented. Voice vote, all ayes, motion carried. 

Resolution 15-6-20 APPROVAL OF THE MAPLE VIEW CEMETERY PLAT presented.  

NOW, THEREFORE BE IT RESOLVED, that the Clark County Board of Supervisors approves the creation of a cemetery as platted certified on June 1, 2020, Lot 1 of Certified Survey Map 2684 being in the NE ¼ of the SW ¼ of Section 25, T26N, R1E, Town of Sherman, in Clark County, Wisconsin.

BE IT FURTHER RESOLVED, that the Clark County Clerk shall record said plat and resolutions of the Town of Sherman and Clark County Boards approving such cemetery plot within 30 days as required by Wis. Stat. 157.07.

Motion by Supervisor Zank seconded by Supervisor Wilcox to approve the resolution as presented. Chairman Hendrickson yielded the floor to Derek Weyer, Planning & Zoning Administrator to answer questions regarding the cemetery plats. Voice vote, all ayes, motion carried. 

Resolution 16-6-20 APPROVAL OF THE POPPLE RIDGE MENNONITE CEMETERY PLAT presented.  

NOW, THEREFORE BE IT RESOLVED, that the Clark County Board of Supervisors approves the creation of a cemetery as platted certified on March 26, 2020, Part of Lot 1 of Certified Survey Map 2805 located in the SW ¼ of the NW ¼ of Section 24, T29N, R1E, Town of Mayville, in Clark County, Wisconsin.

BE IT FURTHER RESOLVED, that the Clark County Clerk shall record said plat pending approval of the Town of Mayville resolution, and Clark County Boards approving such cemetery plot within 30 days as required by Wis. Stat. 157.07.

Motion by Supervisor Wilcox seconded by Supervisor Olson to approve the resolution as presented. Voice vote, all ayes, motion carried. 

Resolution 17-6-20 APPROVING AMENDMENTS TO THE CLARK COUNTY EMPLOYEE HANDBOOK AND ADMINISTRATIVE MANUAL - TELECOMMUTING presented.  

NOW, THEREFORE BE IT RESOLVED, the Clark County Board of Supervisors hereby approves the proposed revisions to the Clark County Employee Handbook and Administrative Manual as set forth in Exhibit A with such revisions becoming effective immediately.

Motion by Supervisor Krempasky seconded by Supervisor Amacher to approve the resolution as presented. Chairman Hendrickson yielded the floor to Janilee Zvolena, Personnel Director to explain the resolution and answer questions.  Chairman Hendrickson yielded the floor to Pam Kernan, Social Services Director, Pam spoke in favor of the resolution.  Roll call vote, motion carried.  28 yes, 1 absent.  Absent was Supervisor Rogers.

Ordinance 232-6-20 APPROVING AMENDMENTS TO CLARK COUNTY CODE OF ORDINANCES, CHAPTER 16 – HEALTH AND SAFETY presented. 

Motion by Supervisor Kodl seconded by Supervisor Williams to approve the first reading of the ordinance as presented.  

County Attorney Jacob Brunette explained the ordinance.  

Motion by Supervisor Wilcox seconded by Supervisor Lange to amend the ordinance, Exhibit A, Sec. 16-133 Enforcement; Penalty (a) (1) by striking “local health officer or”.  Chairman Hendrickson yielded the floor to Todd Olson to speak regarding the ordinance.  Voice vote on amendment to Ordinance 232-6-20, motion carried.  Supervisor Leichtman, Flink and Amacher recorded a no vote.

Roll call vote on the first reading of Ordinance 232-6-20, motion carried.  20 yes, 8 no and 1 absent.  Voting no were Supervisors Amacher, Luchterhand, Bower, Rollins, Boon, Gerhardt, Garbisch and Neville.  Absent was Supervisor Rogers.

Minutes:

The April 21, 2020 Board Minutes were presented in written form for approval.  Motion by Supervisor Zank seconded by Supervisor Boon to approve the minutes as presented.  Voice vote, all ayes, motion carried.

Motion by Supervisor Waichulis seconded by Supervisor Garbisch to adjourn to the call of the Chairman. Voice vote, motion carried.  Meeting adjourned at 1:54 pm.
